This privacy policy informs you about the nature, scope, and purpose of the collection and use of personal data on our website www.wormup.ch (hereinafter "website") by WormUp GmbH (hereinafter "we" or "us") and provides information about your rights. These rights are governed by applicable data protection laws.

We take the protection of your personal data very seriously. We treat your personal data confidentially and comply with the legal data protection regulations as well as this privacy policy.

We would like to point out that data transmission over the Internet (e.g., when communicating by email) may have security vulnerabilities. Complete protection of data against access by third parties is not possible.

3 Data Collection on this Website

Newsletter

On the Internet pages of WormUp GmbH, users are given the opportunity to subscribe to our company's newsletter. When you subscribe to the newsletter, we collect at least your email address.

We use your email address to send you the newsletter by email.

WormUp GmbH informs its customers and business partners at regular intervals via newsletter about the company's offers. The newsletter of our company can only be received by the data subject if (1) the data subject has a valid email address and (2) the data subject registers for newsletter delivery. For legal reasons, a confirmation email will be sent to the email address initially registered by the data subject for newsletter delivery using the double opt-in procedure. This confirmation email is used to verify whether the owner of the email address, as the data subject, has authorized receipt of the newsletter.

When registering for the newsletter, we store the registration and confirmation time, as well as the IP address, email address, first and last name. Changes to your data stored with MailChimp are also logged.

The personal data collected as part of a newsletter registration will only be used to send our newsletter. Furthermore, subscribers to the newsletter may be informed by email if this is necessary for the operation of the newsletter service or for registration, such as in the event of changes to the newsletter offering or changes to technical conditions. The personal data collected as part of the newsletter service will not be passed on to third parties.

The subscription to our newsletter can be canceled by the data subject at any time. The consent to the storage of personal data, which the data subject has given us for newsletter delivery, can be revoked at any time. Each newsletter contains a corresponding link for revoking consent. Furthermore, there is the possibility to unsubscribe from newsletter delivery directly on the website or to inform the data controller in another way.

MailChimp

The newsletters are sent via "MailChimp," a newsletter distribution platform of the US provider Rocket Science Group, LLC, 675 Ponce De Leon Ave NE 5000, Atlanta, GA 30308, USA.

The data of our newsletter recipients is stored on MailChimp's servers in the USA. MailChimp uses this information to send and evaluate newsletters on our behalf. MailChimp may also use this information for its own information to optimize or improve its own services, e.g., for technical optimization of newsletter delivery and presentation or for economic purposes to determine the countries from which recipients come. However, MailChimp does not use the data of our newsletter recipients to contact them or to pass the data on to third parties. We trust in the reliability and IT and data security of MailChimp. MailChimp is certified under the US-EU data protection agreement "Privacy Shield," which obliges it to comply with EU data protection requirements. This is a contract in which MailChimp agrees to protect the data of our users, to process it in accordance with its data protection regulations on our behalf, and in particular not to pass it on to third parties.

Mailchimp: Statistical Collection and Analysis

We use an analysis service to measure the reach of our newsletter. The newsletter's open rate and the links clicked by recipients are measured.

The newsletters contain a so-called "web beacon," i.e., a pixel-sized file that is retrieved from MailChimp's server when the newsletter is opened. As part of this retrieval, technical information such as information about the browser and your system, as well as your IP address and the time of retrieval, are first collected. This information is used for technical improvement of the services based on the technical data or the target groups and their reading behavior based on the retrieval locations (which can be determined using the IP address) or the access times. The statistical surveys also include determining whether the newsletters are opened, when they are opened, and which links are clicked. Although this information can be assigned to individual newsletter recipients for technical reasons, it is neither our nor MailChimp's intention to observe individual users. Rather, the evaluations help us to recognize the reading habits of our users and to adapt our content to them or to send different content according to the interests of our users.

Mailchimp: Termination/Revocation

You can cancel the receipt of our newsletter at any time, i.e., revoke your consents. At the same time, your consent to its delivery via MailChimp and the statistical analyses will expire. A separate revocation of delivery via MailChimp or statistical analysis is unfortunately not possible. You can find a link to unsubscribe from the newsletter at the end of each newsletter.

Mailchimp: Legal Basis of the General Data Protection Regulation

In accordance with the requirements of the General Data Protection Regulation (GDPR) applicable as of May 25, 2018, we inform you that the consents to the sending of email addresses are based on Art. 6 para. 1 lit. o, 7 GDPR as well as § 7 para. 2 no. 3, or para. 3 UWG. The use of the dispatch service provider MailChimp, performance of the statistical surveys and analyses, and logging of the registration process are based on our legitimate interests pursuant to Art. 6 para. 1 lit. f GDPR. Our interest is in the use of a user-friendly and secure newsletter system that serves both our business interests and the expectations of users.

4 Disclosure of Data to Third Parties

We do not disclose your data to third parties. WormUp does not rent, sell, or exchange personal data. However, to the extent permitted, we work with external service providers within the scope of our business activities and the processing purposes listed above. All order data processors receive personal data only to the extent necessary for the performance of the service and for the necessary duration. These include the following entities:

  • Service providers commissioned by us (banks, IT, personnel, accounting, printing companies, logistics companies, online payment platforms, marketing platforms)

These are mostly based in Switzerland or in member states of the European Union (EU) or the European Economic Area (EEA).

5 Your Rights

To the extent provided for by the applicable data protection law, you have the right to obtain information free of charge about the personal data stored about you, its origin and recipients, and the purpose of data processing. Under the legal conditions, you also have the right to correction, deletion, restriction or objection to processing, and, if the GDPR applies, the right to receive this data in a structured, commonly used and machine-readable format.
